Cheryl specialises in acting for national housebuilders together with regional developers buying and selling land for residential development with expertise on conditional contracts, options, promotion agreements, hybrids option and promotion agreements, collaboration agreements and the host of ancillary documents related to those.
Cheryl also acts for developers and promoters when entering into long term strategic options or planning and promotion agreements.
Experience
- Acting on a joint housebuilder scheme on the multi-phase collaboration scheme in North Yorkshire including complex overage provisions with multiple landowners and the involvement of Network Rail together with onward commercial sales.
- Advising a national promoter in relation to Planning and Promotion Agreements and onward sales.
- Acting on behalf of a new entrant to the market on an unconditional contract on a flagship scheme which required careful consideration of ongoing, post completion, biodiversity gain requirements on the landowner whilst liaising with the specialist property lender on the property due diligence and layered security arrangements required.
- Advising on a complex 700-unit mixed use scheme involving multiple landowners and a promoter appointed including complex layered servicing obligations on the developer, security arrangements, multiple overage agreements and an option agreement in favour of a third party.
- Advising on a collaboration scheme on behalf of a top 10 national housebuilder substituting into an ongoing contract negotiation with the landowner in order to acquire, jointly with a separately represented developer, the final phase of a scheme in the North-East.
